Welcome to Obsess AI. These Terms of Service ("Terms") govern your access to and use of our AI-powered content marketing platform for Shopify stores. By accessing or using our services, you agree to be bound by these Terms.

1. Definitions

  • Automated content publishing to your Shopify store
  • Analytics and performance tracking

We continuously improve our Service and may add, modify, or remove features at any time. We will provide reasonable notice of material changes.

4. Subscription and Billing

4.1 Free Trial

New users may be eligible for a free trial period. At the end of the trial, you will be automatically enrolled in the subscription plan you selected unless you cancel before the trial ends.

4.2 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice
  • You authorize us to charge your payment method for all fees

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will retain access until then.

5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, or defamatory
  • Infringe on intellectual property rights of others
  • Spread misinformation or deceptive content
  • Generate spam or unsolicited promotional material
  • Attempt to reverse engineer, hack, or compromise our systems
  • Use automated tools to access the Service beyond normal use
  • Resell or redistribute generated content as a competing service
  • Violate any applicable laws or regulations

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including all software, algorithms, designs, and documentation, is owned by Obsess AI and protected by intellectual property laws. You may not copy, modify, or distribute our proprietary technology.

6.2 Your Content

You retain ownership of your original content and data. By using our Service, you grant us a license to process your data to provide the Service. Generated content is licensed to you for use in your business.

6.3 Generated Content

Content generated through our Service is licensed to you for commercial use in your Shopify store and marketing materials. You are responsible for reviewing and ensuring generated content is accurate and appropriate before publication.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Generated content will be free from errors or inaccuracies
  • The Service will meet your specific requirements
  • Results from using the Service will achieve specific outcomes

You are solely responsible for reviewing all generated content before publication. AI-generated content may contain errors, inaccuracies, or biases.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBSESS AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or content
  • Business interruption
  • Damages resulting from published content

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Obsess AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Content you publish using the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

10. Termination

We may suspend or terminate your access to the Service:

  • For violation of these Terms
  • For non-payment of fees
  • If required by law
  • If we discontinue the Service (with reasonable notice)

Upon termination, your right to use the Service ends immediately. You may export your data for 30 days following termination. Sections that by their nature should survive termination will remain in effect.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit.

Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes, we will provide additional notice via email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

We are not responsible for Shopify's services, availability, or any changes to their platform that may affect our Service.
